Oracut

Terms and Conditions

Last updated: 14 October 2026

This English version is a translation provided for information. The contract language is German; in case of discrepancies, the German version prevails.

§ 1 Scope and provider

  1. These terms apply to all contracts for the use of “Oracut” (website www.oracut.com and the Oracut plugin for ChatGPT) between you and Handgraaf, Luca & Leineweber, Kai GbR, Girardetstraße 76, 45131 Essen, Germany (“we”).
  2. A consumer is any natural person who concludes the contract for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code, BGB). A business is any person acting in their trade, business or profession (§ 14 BGB).
  3. Conflicting terms of businesses only apply if we expressly agree to them in writing.
  4. The contract language is German.

§ 2 Services

  1. Oracut is an online service for uploading videos in which someone speaks and automatically creating short 9:16 clips from them. Oracut transcribes the speech, picks the right passage for the chosen target length for longer videos, removes pauses, filler words and slips of the tongue, adds captions and optionally motion graphics, and provides the finished clip for download. You can change the cut, captions and motion graphics in the editor. Oracut never publishes anything on your behalf.
  2. Oracut is used via the Oracut plugin in ChatGPT. You need your own ChatGPT account, which is governed solely by OpenAI’s terms. We are not responsible for the availability, features or costs of ChatGPT.
  3. Technical limits: videos in MP4, MOV or WebM with an audio track, at least 15 seconds and at most 45 minutes long and at most 6 GB, up to 5 videos at a time; target length of a clip 15 to 180 seconds. One uploaded video results in one clip.
  4. We may develop and change Oracut where there is a valid reason (e.g. technical development, security, changes in law or in third-party services such as OpenAI), provided this causes you no additional cost and we inform you clearly. If a change impairs your access to or use of Oracut more than insignificantly, we will inform you at least 30 days in advance and you may terminate the contract free of charge within 30 days (§ 327r BGB).

§ 3 Account

  1. You need an account and must be at least 16 years old. Paid plans may only be purchased by adults or by minors with the consent of their legal guardians.
  2. Your details must be accurate. The account is personal and not transferable; keep your credentials secret and inform us immediately of any suspected misuse.
  3. The account can only be used once you have confirmed your email address via the link in our confirmation email.

§ 4 Conclusion of contract

  1. The presentation of Oracut on our website is not a binding offer. By submitting the registration you offer to conclude a contract for the Free plan; the contract is concluded when we activate your account (confirmation of your email address).
  2. Paid plans are purchased via the checkout of our sales partner Lemon Squeezy, LLC (USA), which acts as reseller (“merchant of record”), handles purchase and payment, issues the invoice and remits VAT. Lemon Squeezy’s buyer terms additionally apply to the order and payment. Before submitting the order you can review and correct your details; by clicking the order button you make a binding offer. The contract is concluded with the order confirmation. We provide the services of the purchased plan.
  3. We store the contract text (these terms in the applicable version) and the time of your acceptance. You can view and save the current version on this page at any time.

§ 5 Plans and credits

PlanPrice / monthCredits / monthExportStorageRe-renders per clip
Free€030up to 720p, with watermarkoriginals 7 days, clips 7 days1
Starter€7.00150up to 1080poriginals 14 days, clips 60 days5
Pro€15.00400up to 2160p (4K)originals 14 days, clips 60 days5 (4K: 3)
  1. 1 credit equals one started minute of the uploaded original video, regardless of target length and resolution. Credits are reserved when a clip is created and finally charged with the first finished clip. If processing fails before a finished clip exists, the reserved credits are returned automatically.
  2. A plan’s credits are granted at the start of each billing month and expire at its end. Unused credits are not carried over, paid out or refunded. Credits have no monetary value and are not transferable.
  3. Re-renders: changing the cut creates a 720p preview; the clip is then exported once in full resolution. If only captions or motion graphics change, the new export counts as a re-render. The number of free re-renders per clip is shown in the table. A failed re-render is not counted.
  4. The export resolution is limited by the plan and by the resolution of the original video; videos are not upscaled.

§ 6 Prices, payment and term

  1. Prices of paid plans are final prices including German VAT (19%). For customers in other countries the final price may differ due to local VAT; the final price shown in the checkout applies.
  2. Paid plans run for one month (billing month from the day of purchase) and renew automatically for another month unless cancelled. The fee is due in advance at the start of each billing month and is collected by Lemon Squeezy using the chosen means of payment.
  3. We will notify you of price changes for running subscriptions by email at least six weeks before they take effect. They only take effect if you agree. If you do not agree, your plan continues at the previous price; we may then terminate it with one month’s notice to the end of a billing month.
  4. An upgrade to a higher plan takes effect immediately and starts a new billing month; the difference is settled via Lemon Squeezy.

§ 7 Cancellation and account deletion

  1. You can cancel a paid plan at any time effective at the end of the current billing month – via the button “Cancel contracts here”, via Lemon Squeezy’s customer portal or by email to support@oracut.com. You keep the plan until the end of the paid month; your account then continues on the Free plan.
  2. You can end the Free plan at any time by deleting your account under My account. Deletion irrevocably removes all videos, clips and data of your account. If you have a paid plan, we cancel it with the deletion effective at the end of the current billing month; fees already paid are not refunded pro rata unless required by law.
  3. We may terminate the Free plan with four weeks’ notice and paid plans with one month’s notice to the end of a billing month. Free accounts unused for 24 months may be deleted after four weeks’ notice by email.
  4. Both parties’ right to terminate for good cause remains unaffected. Good cause exists for us in particular if you seriously or repeatedly, despite a warning, breach § 9.
  5. Cancellations must be made in text form (e.g. email or our cancellation form).

§ 8 Your content

  1. All rights in your videos and the clips created from them remain with you or the respective rights holders.
  2. You grant us the non-exclusive, free right, limited to the storage period, to store, process and edit your content (cut, captions, motion graphics, framing) and to transmit it to our technical service providers – solely to provide Oracut to you. We do not use your content for any other purpose, in particular not for advertising or training AI models, and do not view it unless you expressly ask us to (e.g. in support) or we are legally obliged to (§ 10).
  3. You warrant that you hold all rights in the uploaded content required for use with Oracut and for your intended use of the clips – in particular copyright, neighbouring and music rights – and that all recognisable people shown or heard have consented to the recording, editing and intended publication.
  4. You alone are responsible for publishing your clips (e.g. on Instagram, TikTok or YouTube).

§ 9 Prohibited use

You may not use Oracut to:

  • upload or create illegal content, in particular child sexual abuse material, glorification of violence, incitement to hatred, terrorist propaganda, insults or threats;
  • infringe third-party rights, in particular copyright, trademark and personality rights (e.g. secret recordings or content without the consent of the people shown);
  • deceive people, e.g. through misleadingly manipulated statements of real people (“deepfakes”);
  • process pornographic content or content unsuitable for minors;
  • distribute malware, attack or overload Oracut, circumvent technical protections or usage limits, or scrape it;
  • resell Oracut or access to it without our consent or create multiple free accounts to circumvent limits.

§ 10 Handling illegal content

  1. Anyone can report illegal content via our notice form. We review notices in a timely, diligent and objective manner.
  2. If we become aware of content that is illegal or breaches § 9, we may block or delete it and temporarily suspend access to Oracut. In case of repeated manifest violations we suspend the account for a reasonable period after a prior warning. We inform you of any such measure with a statement of reasons unless legally prevented. You may lodge a complaint within six months by email to support@oracut.com; we will review it again and inform you of the outcome. You may also turn to a certified out-of-court dispute settlement body under Art. 21 of the Digital Services Act or to the courts.
  3. Where there are indications of a criminal offence threatening the life or safety of persons, we inform the competent law enforcement authorities.

§ 11 Artificial intelligence

  1. Oracut uses AI models for transcription, choosing the passage, the title and motion graphics. AI results may be wrong or unsuitable (e.g. misheard words or a poor selection). Check your clips before publishing; you can correct captions, cut and selection in the editor.
  2. We owe the creation of the clip according to the described features, but no particular content-related or commercial success (e.g. reach).

§ 12 Availability and warranty

  1. We strive for uninterrupted operation. Maintenance, security updates and disruptions for which we are not responsible (e.g. at ChatGPT, internet or data centre providers) may temporarily limit use. We carry out maintenance at low-usage times where possible.
  2. Statutory warranty rights apply, for consumers in particular the provisions on digital products (§§ 327 et seq. BGB).

§ 13 Retention periods and backups

  1. Original videos and finished clips are deleted automatically and irrevocably after the periods stated in § 5. Download your clips in time. Restoration after the period is not possible; a new export requires the original video.
  2. Oracut is not an archive or backup service. Keep originals and finished clips yourself.

§ 14 Liability

  1. We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given.
  2. In case of slight negligence we are only liable for breach of an essential contractual obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely, limited to the foreseeable damage typical for the contract.
  3. For loss of data in case of slight negligence we are only liable for the effort that would have been needed to restore it had you regularly backed it up. Scheduled deletion under § 13 is not data loss.
  4. Otherwise our liability is excluded. These rules also apply to our partners, employees and vicarious agents.

§ 15 Indemnity

If third parties assert claims against us for an infringement based on your content or your use of Oracut for which you are responsible, you indemnify us against these claims including reasonable legal defence costs. We will inform you of such claims without delay and give you the opportunity to comment.

§ 16 Changes to these terms

We may change these terms for the future if Oracut, the law or our service providers’ terms change. We will notify you of changes by email at least six weeks before they take effect. Changes only take effect if you agree. If you do not agree, the previous terms continue to apply; we may then terminate the contract in accordance with § 7(3). Changes under § 2(4) remain unaffected.

§ 17 Right of withdrawal for consumers

Consumers have a statutory right of withdrawal for paid plans. You can also declare your withdrawal using our button “Withdraw from contract”. If you request that we begin performance before the withdrawal period ends (the credits are available to you immediately after purchase), you owe compensation for the services provided up to the withdrawal.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Handgraaf, Luca & Leineweber, Kai GbR, Girardetstraße 76, 45131 Essen, Germany, E-Mail: support@oracut.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You can use the model withdrawal form below, but you are not obliged to do so. You can also declare your withdrawal using the withdrawal function on our website (“Withdraw from contract”).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

Model withdrawal form

§ 18 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 19 Final provisions

  1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law applies only insofar as you are not deprived of the protection of mandatory provisions of the country of your habitual residence.
  2. If you are a merchant, a legal entity under public law or a special fund under public law, or have no general place of jurisdiction in Germany, the place of jurisdiction for all disputes is Essen, Germany. Mandatory statutory places of jurisdiction remain unaffected.
  3. Should individual provisions be invalid, the remainder of the contract remains valid; the statutory provisions replace the invalid provision (§ 306 BGB).
